Terms of use for Irdora
The short version: recording other people lawfully is your responsibility, everything Irdora writes is produced automatically and can be wrong, and you check what matters against the recording before you rely on it.
Section 1: What these terms cover
Irdora is made by Nikola Sretenovic, trading as Handful Apps ("I", "me"). You accept these terms when you tap Agree and continue in Irdora, and by downloading, opening or using Irdora, or by buying Irdora Pro. If you do not agree, do not use the app.
If you are under 18, a parent or guardian must agree to these terms for you, and is responsible for how you use Irdora.
Your licence to the software itself is Apple's Licensed Application End User Licence Agreement, accepted when you download from the App Store. These terms add what a general licence does not cover: recording other people, the limits of automatic transcription and summaries, health information, and purchases. Where the two disagree about the licence to the software, Apple's agreement applies. On everything else, these terms apply as well as Apple's.
Section 2: Recording other people is your responsibility
You alone decide what you record, where and of whom, and you alone are responsible for doing it lawfully. The law on recording conversations differs between countries, states and settings. Some places require everyone in the conversation to agree. Workplaces, hospitals and surgeries, schools and universities, courts, and private property often have their own rules. Professional secrecy, confidentiality agreements and the rights of the people you record can also apply.
Before you record, it is your responsibility to find out what applies where you are, to tell the people in the conversation and get their agreement where that is required, and to follow any rules of the place you are in. The same applies to keeping, sharing, exporting or publishing a recording, a transcript or anything Irdora writes from them. A lecture, a talk or a performance can also be protected by copyright or by the rules of the place where it is given.
The note Irdora shows before your first recording is a reminder, not legal advice, and it is not a statement that any recording is lawful. Never use Irdora to record anyone in secret where that is not allowed, to harass or watch anyone, or to break a duty of confidentiality.
Your recordings never reach me. I cannot see, check, stop or remove what you record, and I have no part in it.
Section 3: What Irdora writes can be wrong
Everything Irdora writes is produced automatically, by speech recognition and language models running on your device. That includes the transcript, which speaker said what, speaker names carried through a recording, titles, In brief, summaries in every template, rewrites, the template it suggests, mind maps and outlines, action items with who and when, the dates it reads from what was said, answers to your questions, series and Since last time, tracked figures and their charts, exports, and what is read aloud.
Any of it can be wrong. Speech recognition mishears words, names and numbers, especially with noise, accents, several people talking at once, or technical and medical terms. It can hear "15" where "50" was said. A sentence can be given to the wrong speaker. A summary can leave out something that matters, misstate it, or put it under the wrong heading. A date can be read from a phrase wrongly. An answer can miss what is in the recording.
Irdora copies figures as they appear in the transcript and discards a point that holds a number nobody said, but it cannot be more accurate than the transcript it copies from. Before you rely on anything Irdora writes, check it against the recording: tap the point to open the transcript, and tap the sentence to hear it. Where it matters, check with the person who said it.
A transcript or summary from Irdora is not a certified or verbatim record, and it is not suitable as evidence or as the only record of anything important.
Section 4: Not advice, and not for emergencies
Irdora is a recording and note-taking tool. It is not a medical device, and nothing it writes is medical, legal, financial or other professional advice. It does not diagnose, treat or prevent any condition, and it does not check whether what was said is correct.
If you record a medical appointment, the instructions of your doctor, pharmacist or other professional come first, in the form they give them: a prescription, a label, a letter or a written plan. Do not change a dose, start or stop a medicine, or make any decision about your health, money, legal position or safety on the strength of a transcript or summary alone. Ask the professional.
Do not use Irdora where a mistake, a delay or a failure could hurt someone. In an emergency, call your local emergency number.
Section 5: Action items, Reminders and Calendar
Action items are suggestions written from the recording, and they can be incomplete or wrong, with the wrong person, task or date. Irdora shows the phrase as said beside the date it read from it so you can check. Nothing is added to Reminders or Calendar until you tap to add it, and you are responsible for checking each one before you do.
Reminders and Calendar are Apple's apps. Whether a reminder or an event alerts you, and when, is decided by iOS and your settings, not by Irdora. I am not responsible for a missed appointment, deadline, dose or task, whether or not Irdora listed it, read its date correctly, or added it.
Section 6: Your recordings, and keeping them safe
What you record, and what Irdora writes from it, is yours, and you are responsible for it. It is kept on your device, and in your own iCloud if you turn on sync. I have no copy and no way to get one, so I cannot recover anything that is lost.
Recordings and their summaries can be lost: if the device is lost, damaged or reset, if the app is deleted, if storage runs out, if an iOS update, iCloud or a fault in the app goes wrong, or if you delete them. Keep your own copy of anything you need, for example by exporting it. A recording's audio does not sync, so it exists only on the device that made it.
Section 7: What you may not do
Use Irdora only lawfully and only for yourself. Do not use it to break anyone's privacy, confidentiality or copyright, to record or keep content you have no right to, or to harass anyone. Do not copy, resell, modify, or take apart the app, except where the law allows it regardless of these terms. If you break these terms, your right to use Irdora under them ends.
Section 8: Irdora Pro, renewals and refunds
Irdora Pro is needed to use the app. It is sold as a lifetime one-time purchase, a yearly subscription, or a weekly subscription. The prices, and whether a free trial is offered to you and for how long, are shown in the app before you buy. Apple takes the payment, in the currency of your App Store.
Subscriptions renew automatically unless you cancel at least 24 hours before the current period ends, and your Apple Account is charged within the 24 hours before it ends. A free trial that is not cancelled at least 24 hours before it ends becomes a paid subscription. Manage or cancel in Settings, your name, Subscriptions. Cancelling stops the next renewal and leaves the current period running to its end. I cannot cancel it for you.
The lifetime purchase is one payment with no renewal. It covers Irdora on the Apple Account that bought it, including updates, for as long as I make Irdora available. It is not a promise that the app, or any feature, will exist forever.
Refunds are handled by Apple under its terms and the law where you live. Request one at reportaproblem.apple.com. I cannot issue one. If a purchase does not unlock, tap Restore purchases, and write to me if it still does not.
Section 9: What depends on Apple and your device
Irdora works only on a device that supports Apple Intelligence, with it turned on. Summaries, mind maps and answers are written by Apple's on-device model, and the speech model is delivered by Apple. Apple decides which devices, languages and regions Apple Intelligence supports, and can change that or the model at any time. Sync uses your iCloud, Reminders and Calendar are Apple's apps, and iOS decides when background work runs and when notifications arrive.
I am not responsible for what Apple, iOS, iCloud or your device does or stops doing, and I cannot promise that every feature will keep working on every device, in every language or after every update.
Section 10: No warranty
To the fullest extent the law allows, Irdora is provided "as is" and "as available", with all faults and without any warranty, whether express, implied or statutory. That includes any warranty of accuracy, completeness, reliability, merchantability, satisfactory quality, fitness for a particular purpose, or non-infringement, and any promise that Irdora will be uninterrupted, free of errors, or keep your data safe. No information from me, in the app, on this site or by email, creates a warranty not stated here.
Section 11: Limits on my liability
To the fullest extent the law allows, I am not liable for any indirect, incidental, special, consequential, exemplary or punitive loss or damage, or for any loss of data, recordings, profit, revenue, business, goodwill or opportunity, arising from or related to Irdora, these terms, or your use of or inability to use the app. That includes loss caused by an error in a transcript, a speaker label, a summary, an action item, a date, a reminder, an answer or anything read aloud; by a decision you made relying on any of them; by a missed appointment, deadline or dose; by the loss of a recording; and by any claim from a person you recorded. This applies whatever the legal basis of the claim, and even if I was told the loss was possible.
To the fullest extent the law allows, my total liability for all claims together is limited to the amount you paid for Irdora Pro in the 12 months before the claim arose.
Section 12: Claims about your recordings
To the fullest extent the law allows, you agree to defend, indemnify and hold harmless Nikola Sretenovic and Handful Apps against any claim, loss, liability, cost and expense, including reasonable legal fees, made by anyone else and arising from what you record, from not having the consent or notice the law requires, from how you keep, share, export or publish a recording or anything written from it, or from your breach of these terms or of the law.
Section 13: Your rights as a consumer
Nothing in these terms excludes or limits liability that cannot lawfully be excluded or limited, including liability for death or personal injury caused by negligence, for gross negligence or intent, or for fraud. Your statutory rights as a consumer are not affected, including your rights under European Union consumer law where they apply to you. Where the law where you live does not allow a part of these terms, that part applies only as far as it allows, and the rest of these terms still applies.
Section 14: Which law applies
These terms, and any dispute about them or about Irdora, are governed by the law of Hungary, and the courts of Hungary have jurisdiction.
If you are a consumer living in another country, you keep the protection of the mandatory consumer law of the country where you live, and you may also bring proceedings in its courts. The United Nations Convention on Contracts for the International Sale of Goods does not apply.
Section 15: Changes, the whole agreement, and contact
If these terms change, the new version is posted here with a new effective date. A change that affects an existing subscription is communicated before it applies. Using Irdora after a change means you accept it.
These terms, Apple's licence and the privacy policy are the whole agreement between you and me about Irdora. If I do not enforce a part of these terms, I have not given up the right to. If a part is found unenforceable, the rest stays in force.
